Mike Gorman practices nationwide in the areas of commercial, dealer, franchise, wholesale lending, lender liability and trade practices litigation, bankruptcy litigation, and antitrust litigation and counseling. He represents manufacturers and franchisors in disputes with their dealers, wholesale lenders in disputes with their borrowers, and a variety of businesses in contract, commercial, and trade practice lawsuits. He also represents and counsels clients in antitrust, marketing, and trade practices issues.
Mr. Gorman represents manufacturers and franchisors in disputes with their dealers/franchisees, including termination, encroachments, cure process, parts returns, succession, revisions to dealer/franchise agreements, dealer/franchisee bankruptcy, and supplier bankruptcy; represents and counsels clients regarding matters arising under the Sherman Act, the Clayton Act, and the Robinson-Patman Act as well as unfair competition under state law and trade practices claims and issues; represents and counsels clients in contract, commercial, trade practices, and marketing disputes; creditor representation in bankruptcy. Mr. Gorman also represents lenders in disputes with borrowers, including out-of-trust ("SOT"), workouts, forbearance agreements, lender liability and tying allegations, and borrower bankruptcy.
Mr. Gorman represents employers in disputes with and suits brought by employees, including EEOC, NLRB and state human rights matters.
Mr. Gorman serves as Executive Vice President of McDowell Rice.
